www.bebodywise.co.uk, an internet based portal (hereinafter referred to as ‘Website’) is operated by Mosaic Wellness Limited (hereinafter referred to as ‘Company’ or ‘We’ or ‘Our’ or ‘Us’), a company duly incorporated and registered in England and Wales under company number 16638894, with its registered office at 36 Delaford Road, London, England, SE16 3BS.

Use of the Website is offered to You, subject to acceptance of all the terms, conditions and notices contained in these Terms including applicable policies which are incorporated herein by reference, along with any amendments or modifications made by the Company at its sole discretion and posted on the Website.

For the purpose of these Terms, wherever the context so requires, ‘You’ or ‘User’ shall mean any natural or legal person who has agreed to become a buyer on the Website by providing account information while registering on the Website as a registered User using computer systems.

The revised Terms shall be made available on the Website. Your use of the Website and the Services is subject to the most current version of the Terms made available on the Website at the time of such use. You are requested to regularly visit the Website to view the most current Terms. It shall be your responsibility to check the Terms periodically for changes.

By (i) using this Website or any facility or service provided by this Website in any way; or (ii) merely browsing the Website, You agree that You have read, understood and agreed to be bound by these Terms, the Website’s Privacy Policy, and such other rules, guidelines, policies, terms and conditions as are relevant under applicable law. You must be at least 18 years old to purchase from us. By placing an order, You confirm You meet this requirement.

Products and Services

The Website is a platform that facilitates the online purchase by the User of health and wellness supplements, skincare and beauty products, and related services offered by the Company (‘Products and Services’). The sale and purchase of Products and Services between the Company and You shall be governed by these Terms.

We make every reasonable effort to ensure accuracy but cannot guarantee that product descriptions or other content are entirely free from error. Images of Products are for illustrative purposes only. Actual packaging, colour, and appearance may vary slightly.

The Company reserves the right to change or modify these Terms or any policy or guidelines of the Website at any time and in its sole discretion. Any changes or modifications made will be effective immediately upon posting the revisions on the Website.

Content displayed on the Website, including product information, is for general information purposes only and does not constitute professional medical advice, diagnosis, treatment or recommendation of any kind. Our Products are not intended to diagnose, treat, cure, or prevent any disease or medical condition. They are not a substitute for professional medical advice. Please consult a qualified healthcare professional before using our Products if You have any existing medical conditions, are pregnant, breastfeeding, or taking medication.

Placing an Order

When You place an order on our Website, You are making an offer to purchase Products subject to these Terms. A contract is only formed between us when we send You an order confirmation email. We reserve the right to decline or cancel any order at our discretion — for example, if a Product is out of stock, if payment is declined, or if we suspect fraudulent activity.

You will receive an acknowledgement email immediately after placing Your order, followed by a separate order confirmation once Your order has been accepted and processed. Please check Your confirmation email carefully and contact us promptly if any details are incorrect.

The listing of Products on the Website constitutes an invitation to treat and not an offer for sale. The placement of an order by You constitutes an offer by You to enter into an agreement with the Company. Acceptance of that offer is only completed when we send You a confirmatory order confirmation email following verification of stock availability.

By placing an order You confirm that You are 18 or over and are legally capable of entering into binding contracts under English law. Our Products are intended for personal use only and not for resale unless You have entered into a separate written agreement with us.

Pricing Information and Payment

All prices on the Website are shown in pounds sterling (£) and include VAT at the applicable rate, unless otherwise stated. Delivery charges are shown separately at checkout before You complete Your order.

We reserve the right to change prices at any time. Prices in force at the time You place Your order will apply to that order. In the event of a pricing error, we will contact You before processing Your order to offer the correct price or cancel the order with a full refund.

By initiating a purchase on the Website You are entering into a legally binding and enforceable contract to purchase the Products via the payment method selected at checkout. We accept major debit and credit cards including Visa, Mastercard and American Express, as well as digital wallets such as Apple Pay and Google Pay where available, and any other payment methods displayed at checkout. Payment is taken at the time of placing Your order (or, for subscriptions, at the start of each billing period). All payment processing is handled by our secure third-party payment provider. We do not store Your full card details.

You confirm that You are the authorised holder of the payment method used in transactions made on the Website. The Company will not be responsible for any financial loss, inconvenience or other harm resulting from misuse of Your account or payment details.

Subscriptions

Some of our Products are available on a subscription basis, meaning You authorise us to charge You on a recurring basis (for example, monthly) until You cancel. Your first payment is taken when You place Your order. Subsequent payments are taken automatically on Your chosen billing cycle. You will receive a reminder notification before each renewal giving You adequate notice to cancel if You wish.

Subscription prices may change. We will give You at least 30 days’ written notice before any price change takes effect. If You do not cancel before the new price takes effect, You will be deemed to have accepted the new price.

You may cancel Your subscription at any time by logging into Your account and selecting ‘Manage Subscription’, or by contacting us at support@bebodywise.co.uk. To avoid being charged for the next billing period, cancellation must be made before Your next renewal date. Cancellation will take effect at the end of Your current paid period. No partial refunds are given for unused days in a subscription period, except where required by law.

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, You have a 14-day right to cancel a new subscription from the date You enter into the contract. Please see the Cancellation Rights section below for full details.

Delivery

We currently deliver to addresses within the United Kingdom only. Delivery options, timescales, and charges will be displayed at checkout before You complete Your order. Delivery timescales are estimates only and not guaranteed. We are not liable for delays caused by circumstances outside our control, including but not limited to carrier delays, extreme weather, or industrial action.

If a delivery attempt fails because You were not available and the carrier is unable to leave Your order safely, Your order may be returned to us. In that case, we will contact You to arrange re-delivery (which may incur an additional charge) or issue a refund for the Products excluding original delivery costs.

Risk in the Products passes to You on delivery. Legal ownership of the Products passes to You once we have received payment in full.

Your Cancellation Rights

You have the right to cancel Your order without giving any reason within 14 calendar days from the day after You (or someone You nominate) receive the Products. This right is protected under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

To exercise Your right to cancel, You must inform us by emailing support@bebodywise.co.uk with Your name, address, order number, and a clear statement that You wish to cancel, or by using the model cancellation form available in Your account area.

If You cancel, You must return the Products to us within 14 days of notifying us, at Your own cost unless the Products are faulty or incorrectly sent. Products must be returned in their original, unopened condition. We will process Your refund including standard delivery costs within 14 days of receiving the returned Products or evidence that they have been returned. We may reduce Your refund if the Products show signs of use beyond what is necessary to establish their nature, characteristics, and functioning.

The right to cancel does not apply to Products that have been opened, used, or that have broken hygiene seals, such as skincare or supplement Products, as these cannot be resold for health and safety reasons once opened.

Returns and Refund Policy

Outside of the 14-day statutory cancellation period, we accept returns only where Products are faulty, damaged, or not as described. We do not accept change-of-mind returns once the cancellation period has passed, except at our discretion. To request a return, contact us at support@bebodywise.co.uk within a reasonable time of discovering the issue. Please do not return Products without contacting us first.

Under the Consumer Rights Act 2015, if Your Product is faulty, damaged in transit, or not what You ordered, You are entitled to a full refund within 30 days of receipt. Between 30 days and 6 months You are entitled to a repair or replacement, or a refund if repair or replacement is not possible or fails. Beyond 6 months You may still have a right to remedy, though the burden falls on You to show the defect existed at the time of purchase. These statutory rights are in addition to, and do not affect, any contractual rights You may have.

Approved refunds will be processed to Your original payment method within 14 days of our authorisation of the return.

Health and Safety

Our Products are intended for use by healthy adults aged 18 and over unless otherwise stated on the Product label. You must read all product labels, ingredient lists, and usage instructions before use. Do not use our Products if You are allergic to any listed ingredient. Keep Products out of reach of children and store them as directed on the label. Do not exceed the recommended daily intake for supplement products. Consult Your doctor or pharmacist before use if You are pregnant, breastfeeding, have a medical condition, or are taking prescription medication.

Nothing on our Website constitutes medical advice. If You experience an adverse reaction to any Product, discontinue use immediately and seek medical attention if necessary. We comply with applicable UK regulations on product safety, labelling, and cosmetics, including the UK Cosmetics Regulation and UK Food Supplements Regulations.

Eligibility of Use

Use of the Website is available only to persons who can form legally binding contracts under English law. Persons who are incompetent to contract, including without limitation minors under the age of 18, are not eligible to purchase from the Website. By accessing and using this Website, You represent that You are of legal age to form a binding contract.

The Company reserves the right to refuse access to the Website or to terminate access granted to existing Users at any time without providing reasons for doing so. You shall not have more than one active account on the Website. You are prohibited from selling, trading, or otherwise transferring Your account to another party.

User Account, Password and Security

The Website may require You to register as a User by creating an account in order to avail of the services provided by the Website. You will be responsible for maintaining the confidentiality of Your account information and are fully responsible for all activities that occur under Your account. You agree to immediately notify the Company of any unauthorised use of Your account or any other breach of security, and to ensure that You log out from Your account at the end of each session.

You shall ensure that the account information provided by You is true, complete, accurate and up-to-date. If You provide any information that is untrue, inaccurate, not current or incomplete, the Company has the right to suspend or terminate Your account and refuse any current or future use of the Website.

User Obligations

Subject to compliance with these Terms, the Company grants You a personal, non-exclusive, non-transferable, limited right to access and use this Website and the services provided herein. You agree to use the services, Website and the materials provided therein only for purposes that are permitted by these Terms and any applicable law or regulation.

You must not use our Website in any way that breaches applicable law or regulation. You must not transmit any unsolicited or unauthorised advertising or promotional material. You must not knowingly introduce viruses, trojans, worms, or other malicious or technologically harmful material. You must not attempt to gain unauthorised access to our systems, server, or any database connected to our Website. You agree that You are solely responsible to the Company for any breach of Your obligations under these Terms and for the consequences of any such breach. The Company reserves the right to review materials posted by You and to remove any materials in its sole discretion. The Company reserves the right to terminate Your access to the Website at any time without notice for any reason whatsoever.

Intellectual Property Rights

The Website and all its content, including but not limited to text, graphics, user interfaces, visual interfaces, artwork, computer code, and the design, structure, selection, coordination, expression, look and feel and arrangement of such content, is owned and controlled by the Company and is protected by copyright, patent, trademark laws, and various other intellectual property rights.

The trade marks, logos and service marks displayed on the Website are the property of the Company or their respective third party owners. You are not permitted to use any marks without the prior written consent of the Company or the relevant third party owner.

‘Be Bodywise’ and related trade marks and logos are trade marks of Mosaic Wellness Limited. Unless otherwise indicated, the Company owns all intellectual property rights in and to the Website, including without limitation any and all rights, title and interest in and to copyright, related rights, patents, designs, know-how, trade secrets, goodwill, source code, meta tags, databases, text, content, graphics, icons, and hyperlinks.

Except as expressly provided herein, You acknowledge and agree that You shall not copy, republish, post, display, translate, transmit, reproduce or distribute any content through any medium without obtaining the necessary authorisation from the Company or third party owner of such content.

Disclaimer of Warranties and Liabilities

To the maximum extent permitted by applicable law, the Website, services and other materials are provided by the Company on an ‘as is’ basis without warranty of any kind, express, implied, statutory or otherwise. Without limiting the foregoing, the Company makes no warranty that the Website or the services will meet Your requirements or that Your use of the Website will be uninterrupted, timely, secure or error-free.

The Company shall not be responsible for the delay or inability to use the Website or related functionalities, or for any information, software, products, functionalities and related graphics obtained through the Website. The Company shall not be held responsible for non-availability of the Website during periodic maintenance operations or any unplanned suspension of access that may occur due to technical reasons or any reason beyond the Company’s control.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, any breach of the terms implied by the Consumer Rights Act 2015, defective products under the Consumer Protection Act 1987, or any other liability that cannot be excluded or limited under English law.

Indemnification and Limitation of Liability

You agree to indemnify, defend and hold harmless the Company including its affiliates, vendors, agents and employees from and against any and all losses, liabilities, claims, damages, demands, costs and expenses asserted against or incurred by the Company that arise out of, result from, or may be payable by virtue of any breach or non-performance of any representation, warranty, covenant or agreement made or obligation to be performed by You pursuant to these Terms.

Subject to the exclusions above, the Company’s entire liability to You under these Terms or otherwise shall not exceed the total price paid by You for the specific Product or service in connection with which the liability arises. In no event shall the Company, its officers, directors, employees, partners or suppliers be liable to You or any third party for any indirect, consequential, or punitive damages whatsoever, including those resulting from loss of use, data or profits, whether or not foreseeable. The limitations and exclusions in this section apply to the maximum extent permitted by applicable law.

Complaints and Disputes

If You have a complaint about our Products or service, please contact us in the first instance by emailing support@bebodywise.co.uk or by writing to Mosaic Wellness Limited, 36 Delaford Road, London, England, SE16 3BS. We aim to acknowledge all complaints within 2 working days and resolve them within 14 working days.

If we are unable to resolve Your complaint to Your satisfaction, You may be entitled to refer it to an approved Alternative Dispute Resolution provider. We will provide You with details of an approved ADR scheme if Your complaint remains unresolved after our internal process. UK consumers may also contact the Citizens Advice Consumer Service for guidance.

Termination and Violation of Terms

The Company may, in its sole discretion and without prior notice, terminate Your access to the Website and block Your future access if the Company determines that You have violated these Terms. If You want to terminate Your agreement with the Company, You may do so by not accessing the Website or by closing Your account.

The Company may at any time, with or without notice, terminate these Terms with You if You breach any of the provisions of these Terms or the Privacy Policy; if the Company is required to do so by law; if the provision of the services to You is no longer commercially viable; or if the Company has elected to discontinue access to the Website or the services.

Privacy Policy

The Company views the protection of Your privacy as a very important principle. How we collect, use, and protect Your personal data is set out in our Privacy Policy, which is incorporated into these Terms by reference. We process Your personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Mosaic Wellness Limited is the data controller for personal data collected through this Website.

The Company may share personal information with another business entity should we plan to merge with or be acquired by that business entity, or in connection with any reorganisation or restructuring of business. Should such a transaction occur, the other business entity or new combined entity will be required to follow the Privacy Policy with respect to Your personal information.

Communications

You hereby expressly agree to receive communications from the Company by way of SMS, emails, phone calls, or WhatsApp relating to Your order (for example, for confirmation of Your order and managing delivery logistics) and relating to the Products and services offered through the Website and by other websites or businesses affiliated with Mosaic Wellness Limited. You may opt out of marketing communications at any time by following the unsubscribe instructions in any such communication or by contacting us directly.

General Provisions

Notice: All notices from the Company will be served by email or by general notification on the Website. Any notice provided to the Company pursuant to these Terms should be sent to support@bebodywise.co.uk.

Assignment: You cannot assign or otherwise transfer these Terms, or any rights granted hereunder, to any third party. The Company’s rights under these Terms are freely transferable by the Company to any third parties without the requirement of seeking Your consent.

Severability: If, for any reason, a court of competent jurisdiction finds any provision of these Terms, or any portion thereof, to be unenforceable, that provision shall be enforced to the maximum extent permissible so as to give effect to the intent of the parties as reflected by that provision, and the remainder of these Terms shall continue in full force and effect.

Waiver: Any failure by the Company to enforce or exercise any provision of these Terms, or any related right, shall not constitute a waiver by the Company of that provision or right.

Governing Law

These Terms and all transactions entered into on or through the Website and the relationship between You and the Company shall be governed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms or the relationship between You and the Company shall be subject to the exclusive jurisdiction of the courts of England and Wales, without prejudice to Your right as a consumer to bring proceedings in the courts of the country in which You are resident. Nothing in these Terms affects Your statutory rights as a consumer under English law.
